The culmination of a case typically occurs with a prosecutor’s decision on case resolution. Many factors go into this ultimate decision. First and foremost, a prosecutor must have a firm grasp of ethical obligations. Another key factor is the knowledge that a fair and just resolution will look different based on the specific details of the case. At the forefront of those considerations are both safety of the community and victim’s rights and wishes. While on its face, it may not appear that the concerns for community safety and victim autonomy are opposing goals, however, prosecutors may find themselves with cases in which those these goals may not align. This CLE explores the considerations involved in making the ultimate decision on resolving a case whether that be by plea or trial.

Anticipated CLE credits: 1.00 Credits
NDAA has applied for CLE credit in Illinois, Kansas, Mississippi, Ohio, Tennessee, Texas, and Virginia based on state requirements and guidelines. All other attorneys seeking CLE credit should contact their state bar for more information. At the conclusion of the course and after completion of the electronic evaluation survey, all attendees will receive a uniform continuing education certificate that they may use to report their continuing education hours to their state bar or reporting agency.
