Virtual: Elder Abuse – Financial Exploitation, Physical & Sexual Assaults and Homicide

Presented by Paul Greenwood, Deputy District Attorney (Retired), Head of Elder Abuse Prosecution Unit, San Diego District Attorney’s Office

The faculty member will explore the unique aspects of investigating and prosecuting cases that involve physical abuse, sexual abuse, financial exploitation or homicide where the victim is an elder individual. He will overview the dynamics regarding these special victims, including stereotypes, i.e. invalid preconceived notions of memory loss, dementia, etc. He will discuss the true value and credibility of these witnesses. Some additional issues discussed include: conquering juror bias with elders as witnesses; charging concerns; challenges when abuse occurs in institutional settings; preparing the witness for pretrial hearings and trial; anticipating and overcoming typical defenses in these cases; methods of corroborating the victim’s account of the assault; researching the areas where your victim is most vulnerable and tackling these and other weaknesses in your case during direct examination; preparing the victim for cross-examination; any unique pretrial motions; use of expert witnesses both to establish medical documentation as well as mental/demeanor evidence; overcoming defense claims in homicide cases and other crimes to watch for in the investigatory stage.

Continuing Legal Education Credits: 2 hours

This course is pending approval in Pennsylvania but has been approved for CLE credit in Georgia, Kansas, Ohio, South Carolina, and Virginia. NDAA will not be applying for CLE credit in the state of Texas. Many states will allow attorneys to receive CLE credit for virtual courses that have been approved in one of these states through reciprocity or self-submission. Please speak with your CLE accrediting body to ensure that they will allow you to self-submit the course for approval if your state is not listed above.

GoToWebinar will log each attendee’s “time in session” for the webinar. All attendees who sign into the webinar and complete the session will be provided a copy of the PowerPoint presentation, speaker biography, and a Uniform CLE Certificate from NDAA staff following the event.

Attendees must self-submit this course for approval in their home state. All attorneys are responsible for any fees associated with CLE filing.
