DOJ Election Threats Task Force

Based on the sharp increase in reported threats to election officials and workers during the 2020 election cycle and the continued reports of efforts to intimidate the election community, the United States Department of Justice has formed a task force dedicated to combatting election-related threats. In this webinar a member of the task force will provide an overview of TF composition and FBI intake procedures; discuss applicable federal statutes, including 18 U.S.C. §§ 245 (threats to election workers), 875 (interstate threatening communications), 2261A (cyberstalking), and 47 U.S.C. § 223 (harassing telephonic communications); provide contact information and best practices for reporting election threats; and will address common challenges, including attribution and First Amendment issues.  The presenter will also seek input from DA’s offices on state and local statutes available to prosecute this conduct.
